1. Scope:

• These General Terms and Conditions (GTC) govern the relationship between Oberturm Uhren und Schmuck GmbH, Vordere Vorstadt 1, 5000 Aarau and Neumarktplatz 2, 5200 Brugg (hereinafter referred to as Oberturm oberturm.ch), and its customers. Deviating agreements require written form to be valid. The current and binding version of the GTC as well as additional agreements and supplements are published at oberturm.ch. These GTC do not apply to purchases made directly in the Oberturm Uhren und Schmuck stores in Aarau or Brugg.

2. Quality:

• Our watch and jewelry collection is characterized by outstanding quality that meets the highest industry standards. Each piece undergoes a strict quality control process to ensure it meets the demanding standards of Oberturm Uhren & Schmuck GmbH.

3. Warranty (new items):

• We offer generous international manufacturer warranties on all new watches, lasting 2 years. For new jewelry, the warranty period varies by manufacturer and is usually 1-2 years. These comprehensive warranties cover all manufacturing and material defects, while specific exceptions apply for loss, damage, or normal wear and tear.

4. Warranty (used items):

• We provide a 6-month in-house warranty on all used watches. This warranty covers the functionality of the watch. No warranty is given for water, shock, or fall damage of any kind. For used watches, there is no warranty on timekeeping accuracy. Also excluded from the warranty are damages caused by improper handling or interventions by the customer or third parties. For all used jewelry, we offer a 6-month in-house warranty with proof of purchase. This warranty covers the functionality of the jewelry (clasp, etc.). No warranty is given for stone loss.

5. Service Warranty:

• We offer a comprehensive 2-year service warranty on all newly purchased gold and silver items. This warranty covers the care and refurbishment of the items to ensure they maintain their original shine and quality throughout the entire warranty period.

6. Availability:

• Orders placed via the platform oberturm.ch are generally shipped to our valued customers within 3 working days after the transaction is completed. Our inventory ensures that all available products already in our store are shipped no later than the third working day after payment receipt. This regulation applies exclusively to products currently in stock. For special orders of wedding rings, please note that the manufacturing process of this special piece of jewelry may take several days. We strive to make this process as efficient as possible to guarantee you a product of the highest quality. Please note that we always make the shipment of your order dependent on the successful completion of the prepayment. Likewise, if the payment method 'Bank Deposit' is selected, shipment will only be made after successful processing of this payment option. If a product, although shown as in stock, is nevertheless unavailable, the shipping preparation may take several days. Automated notifications such as shipping and order confirmations will always inform you about the current status of your order.

7. Legal Provisions:

• Swiss law exclusively applies to all legal relationships, excluding the UN Sales Convention. The place of jurisdiction for all disputes is Aarau. Mandatory legal provisions remain reserved.

8. Retention of Title:

• All delivered goods remain the property of Oberturm Watches and Jewelry until full payment of the purchase price (including all ancillary claims) has been made. Pledging, security transfer, processing, or alteration is not permitted without the express consent of Oberturm Watches and Jewelry. Oberturm Watches and Jewelry is entitled to register the delivered goods in the retention of title register according to Art. 715 of the Swiss Civil Code. If the customer defaults on any payment obligations to us, all existing claims become immediately due.

9. Shipping costs:

• Orders with delivery addresses in Switzerland are shipped free of charge from a minimum order value of CHF 200.00. In case of delivery bottlenecks, Oberturm Uhren und Schmuck oberturm.ch reserves the right to make partial deliveries. Any additional shipping costs will be borne by us.

• Scope and reservation
  Oberturm Uhren & Schmuck GmbH reserves the right to adjust the minimum order value for the free shipping option at any time and without giving reasons, as well as to issue additional conditions. Changes to the minimum order value and/or shipping conditions become effective upon their publication on the website or in the terms and conditions and apply from that time for all new purchases.

  No refund claim
  Payments already made for orders placed or completed before a change in the minimum order value remain unaffected by subsequent adjustments. There is no entitlement to a refund of any difference amounts resulting from a later increase or other modification of the minimum order value for free shipping.

  Effectiveness and notification
  Changes to this regulation will be published on our website. Buyers are obliged to inform themselves about the currently valid minimum order value before placing an order.

10. Payment methods:

• 10.1 Prepayment:

  Our bank details for your prepayment can be found in the confirmation email you receive automatically after completing the order. Your order will be shipped immediately after payment is received.

• 10.2 Payment by debit and credit cards:

  Your secure credit and debit card payments are enabled by PostFinance and Shopify Payments. Both systems meet all common security standards.

• 10.3 Payment with Paypal:

  Use the secure payment option with your Paypal account.

• 10.4 Payment with TWINT:

  Your secure payment via TWINT is enabled by our system.

• 10.5 Payment upon pickup:

  Pay in cash or with debit and credit cards upon pickup. A valid ID is required for payment at pickup.

• 10.6 Payment with financing or purchase on account with installment payment 

  Purchase on account with installment option (POWERPAY) MF Group / POWERPAY offers the payment method "purchase on account" as an external payment service provider. With the individual invoice, you can easily pay for your online purchase by invoice. If you do not make a payment within the specified period, you will receive a monthly invoice with an order overview the following month. Upon conclusion of the purchase contract, POWERPAY takes over the resulting invoice claim and handles the corresponding payment modalities. When purchasing on account, you accept POWERPAY’s terms and conditions in addition to our own.

  By selecting one of these payment methods, you confirm that you have read and accepted or agreed to the contractual terms of POWERPAY. Their terms exclusively apply to the payment processing.

  Please carefully check all details before completing your order. By submitting the order, you expressly agree that POWERPAY will use your personal data to conduct the credit check and, upon positive approval, will handle the payment processing according to their terms and conditions.

  Procedure for 0% financing:

  1. Select the option “0% financing” at checkout.

  2. Enter your date of birth.

  3. Your mobile phone number is required for two-factor authentication.

  4. After successful credit approval, enter the code received via SMS – only then is your order bindingly completed.

  Important:
  Orders with 0% financing are excluded from the return policy according to clause 11.

11. Return Policy:

At Oberturm Watches and Jewelry, we place the highest value on your complete satisfaction with your purchase. Therefore, we offer you an elegant 14-day return policy for all purchases made on our website www.oberturm.ch.

This right of return is subject to the legal provisions and regulations of Switzerland and applies exclusively to purchases made through our website and not to purchases in our physical stores in Aarau or Brugg.

You have the right to withdraw from this contract within 14 days without giving any reason. This means that our customers have a 14-day right of return after receiving the goods.

The withdrawal period is 14 days.

1. In the case of goods, it begins on the day you or a third party named by you, who is not the carrier, took possession of the goods.
2. In the case of digital products (e.g., vouchers), the withdrawal period is 14 days from the day the contract is concluded.

After the 14-day withdrawal period has expired, there is no right of return.

It is sufficient that you send the notification before the withdrawal period expires.

Timely dispatch of the goods is sufficient to meet the deadline. Please note that the goods should only have been worn for fitting purposes, comparable to a visit to an exclusive retail store. We also ask you to return the goods complete and undamaged in the original packaging.

The following items and situations are excluded from the right of return:

• - Wedding rings/engagement rings
• - Sale items
• - Items specially ordered for you
• - Engraved items
• - Gift vouchers
• - Ordered products with 0% financing
• - Ordered products purchased on invoice
• - Used or second-hand purchased watches

Refund:

After receiving and inspecting your return at one of our stores (Aarau or Brugg), we will refund the corresponding amount. You will receive a confirmation email from us upon receipt of your return.

• - Within 14 days after receipt of the return, depending on the chosen payment method.
• - The refund will always be made to the bank account you provided. For payments made via PayPal, Visa, and Mastercard, we can refund the same transaction in case of a credit. Please ensure you have access to the specified bank account, as we cannot be held liable for this.
• - As soon as your return arrives with us, it will be checked and processed. The amount for the returned items will be automatically refunded to the chosen payment method. For payments via TWINT, the refund will be made to your TWINT account. For prepayments, please provide your bank details on the return form.

The return period for items is 14 days after receipt of your shipment.

Please note that we unfortunately cannot accept returns in the following cases:

• Expired return period (14 days after receipt)
• Damaged items
• Missing or damaged original packaging (e.g., tears)
• Missing accessories
• Consumables

12. Product price:

• The prices listed on oberturm.ch are in Swiss Francs (CHF) and include the statutory value-added tax unless otherwise expressly stated. Despite the greatest care in pricing, we reserve the right to adjust prices at any time.

• Due to the highly volatile and sometimes rapidly rising market prices for precious metals, especially gold and silver, regular price adjustments are made. These adjustments are necessary to ensure market-appropriate prices.

• Especially for individually configured products as well as wedding and engagement rings, whose price largely depends on the current precious metal price, there may be price deviations between the time of order and the final order confirmation. The price shown in the online shop in these cases does not constitute a binding offer.

• If it becomes apparent after receiving the order that the price of the ordered product has significantly increased due to precious metal price adjustments or other cost developments, we reserve the right to inform the customer of the adjusted price. The customer can confirm the order under the new conditions or withdraw from the contract without cost.

• Oberturm Uhren & Schmuck GmbH expressly reserves the right to unilaterally cancel an order if the selling price would be below cost and the order is economically unreasonable. Payments already made will be fully refunded. Further claims are excluded.

• By placing an order, the customer expressly agrees to these price adjustment and cancellation policies.
