Delivery Terms

Scope

These terms of delivery apply to all orders placed through the Oberturm Watches and Jewelry website. They govern the rights and obligations of the contracting parties in connection with the delivery of goods, especially jewelry and watches. All contractual relationships are subject to the provisions of the Swiss Code of Obligations (CO) and, where applicable, the Swiss Civil Code (CC). These conditions apply exclusively to orders placed online via our website and not to purchases made in our stores.

Conclusion of Contract and Withdrawal

Oberturm Watches and Jewelry undertakes to accept the buyer's order under the conditions of the website. In the event of typographical, printing, or calculation errors on the website, Oberturm Watches and Jewelry reserves the right to withdraw.

The buyer has the right to withdraw from this contract within fourteen days, taking into account the provisions of the right of withdrawal. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last item. The right of withdrawal does not apply to the following contracts:

  • Contracts for the delivery of goods that are not prefabricated and for whose manufacture an individual selection or determination by the consumer is decisive or that are clearly tailored to the personal needs of the consumer.
  • Contracts for the delivery of sealed goods that are not suitable for return for health protection or hygiene reasons if their seal has been removed after delivery.

Delivery

Unless otherwise agreed, delivery is made from stock to the delivery address specified by the buyer. To keep the total number of packages as low as possible for environmental reasons, we ship all jewelry items of an order together in one package. This means there may be a delivery delay if one of the ordered items is not in stock. If you prefer a partial delivery, please contact our customer service.

Delivery of our items within Switzerland is free of charge for all orders over CHF 200.-. For deliveries to Germany and Austria or other EU countries, please order at oberturm.ch and contact our customer service.

Scope and Reservation
Oberturm Watches & Jewelry GmbH reserves the right to adjust the minimum order value for the free shipping option at any time and without giving reasons, as well as to issue additional conditions. Changes to the minimum order value and/or shipping conditions become effective upon their publication on the website or in the terms and conditions and apply from that time to all new purchases.

No Refund Claim
Payments already made for orders placed or completed before a change in the minimum order value remain unaffected by subsequent adjustments. There is no entitlement to a refund of any difference amounts resulting from a later increase or other modification of the minimum order value for free shipping.

Effectiveness and Notification
Changes to this regulation will be published on our website. Buyers are obliged to inform themselves about the currently valid minimum order value before placing an order.

Delivery Times

Delivery times vary depending on the product:

  • Wedding rings: approx. 3-5 weeks, as these are specially made. We want to ensure the best for our customers.
  • Watches (not in stock): approx. 1-2 weeks.
  • General products, i.e., jewelry, pocket knives (not in stock): approx. 3-5 working days.
  • Products with special manufacturing: approx. 1-3 weeks.
  • Products (in stock, without issues): shipping within 2-3 working days.

Due Date and Payment, Default

You can pay optionally by online transfer with PostFinance Card, Visa, MasterCard, American Express, TWINT, installment payment, and PayPal or by prepayment. If payment by prepayment is not possible for creditworthiness reasons, technical reasons, or due to exceeding amount limits, Oberturm Watches and Jewelry may offer the customer an alternative payment method. If the buyer is in default of payment, Oberturm Watches and Jewelry is entitled to charge default interest.

Retention of Title

This means that ownership of the delivered goods only passes to the buyer when the full purchase price and all other claims that Oberturm Watches and Jewelry has against the buyer have been paid. If the buyer resells or otherwise encumbers the goods before full payment, they hereby assign all claims from this resale or encumbrance to Oberturm Watches and Jewelry.

Warranty and Liability

If there is a defect in the goods for which Oberturm Watches and Jewelry is responsible, the buyer may demand either remedy of the defect or replacement delivery. If Oberturm Watches and Jewelry is not willing or able to remedy the defect/replacement delivery or if this is delayed beyond reasonable periods, the buyer is entitled, at their choice, to withdraw from the contract, demand a corresponding reduction of the purchase price, or claim damages. Unless otherwise stated below, further claims of the buyer—regardless of the legal grounds—are excluded. Therefore, Oberturm Watches and Jewelry is not liable for damages not caused to the delivery item itself; in particular, Oberturm Watches and Jewelry is not liable for lost profits or other financial losses of the buyer. To the extent that liability of Oberturm Watches and Jewelry is excluded or limited, this also applies to the personal liability of employees, representatives, and vicarious agents. The above limitation of liability does not apply insofar as the cause of damage is intent or gross negligence or personal injury is involved. If Oberturm Watches and Jewelry negligently breaches a material contractual obligation, the compensation obligation for property damage is limited to the typically occurring damage.
